Geherin Law Group Helps Exonerate Two Young Men for False Claims

criminal defense Ann Arbor

This month, two young clients of Geherin Law Group, PLLC. can breathe a huge sigh of relief and put their lives back together after being falsely accused of criminal wrongdoing.

They’re fortunate enough that the system worked to make sure they had a fair trial.  And they were fortunate enough to have had the resources to retain a law firm like Geherin Law Group, who fought for them every step of the way to achieve their own personal justice.  Candidly, some people aren’t as fortunate, and end up losing everything over a false allegation.

How is DNA Evidence Found?

criminal defense attorney Ann Arbor

Anytime you touch an object or person, there’s potential for the transfer of cells containing DNA. Here are some circumstances that could lead to Criminal Sexual Conduct charges:

  • sexual penetration without a condom and with ejaculation
  • sexual penetration without a condom and without ejaculation
  • digital penetration, depending on the circumstances
  • oral sex (leaving saliva on or around the genitals of the alleged victim)
  • placing one's mouth on any part of the alleged victims' body
  • placing one's mouth on the alleged victims clothing (transferring saliva in the same way)

How Will I Know If There is DNA Evidence Against Me?

criminal defense attorney Ann Arbor

Your
criminal defense attorney in Ann Arbor will obtain evidence through "discovery." You have the right to see any evidence that the prosecution intends to use against you, as well as any evidence that is helpful to your defense. If DNA evidence is sought by the investigating police agency, they believe there’s some likelihood that DNA may be present. If it comes back matching your DNA, then the prosecution will use the evidence against you. In that case, you would be entitled to the evidence under the Michigan criminal discovery rules. If your DNA is not found, then your criminal defense attorney should argue that that fact is "exculpatory" (or tending to show innocence), and you’re likewise entitled to that evidence in the event you wish to present it in your own defense. This may require filing a special motion.

Have You Been Affected By the Compromised Marijuana Testing? Geherin Law Group Can Help You!

criminal defense attorney Washtenaw County

MSP recently dropped a major bombshell on the criminal justice community: They revealed that their chemical blood testing analysis for THC was badly compromised between March 2019 and August 2022.

Obviously, Michigan prosecutors and police may resist efforts to vacate convictions. They might argue that other evidence supports the conviction (i.e., poor driving, failures on Standardized Field Sobriety Tests).  However, judges may be less than sympathetic to these arguments knowing the police lab analysis was faulty and was prone to false positives. Finding a skilled, successful OWI Defense Attorney to fight for their rights certainly might be the difference between a clean record and the status quo. This is especially pronounced for people who suffered a loss of license, or loss of freedom, due to an OWI Marijuana conviction during this time period.

Geherin Law Group specializes in OWI/DUI defense in Southeastern Michigan, and would be happy to review your case and see what relief might be available.

Learn more about the compromised marijuana testing in OWI/DUI cases here.

If you or a loved one want to talk about your options after a OWI/Marijuana arrest between 2019-2022, contact us. Dan Geherin is a criminal attorney in Washtenaw County serving clients in Ann Arbor and throughout Southeast Michigan and can be reached at (734) 263-2780.

Michigan State Police Drops a Bombshell About Compromised Marijuana Testing in OWI/DUI Cases

criminal defense attorney Washtenaw County

MSP recently dropped a major bombshell on the criminal justice community: They revealed that their chemical blood testing analysis for THC was badly compromised between March 2019 and August 2022. MSP revealed that their testing failed to distinguish between the illegal properties of THC and the
legal property of CBD (Cannabidiol). CBD was legalized in Michigan back in March 2019.  Now, MSP found that their testing may have resulted in CBD being converted to THC during lab analysis, leading to inaccurate results and “false positives.”

For those Michigan drivers who were arrested, prosecuted and possibly convicted (by plea or by trial) of OWI/Marijuana in the 3 ½ years (March 2019 to August 2022) affected, what do they do? For starters, they might want to contact an experienced DUI/OWI defense attorney about relief in the form of a plea withdrawal, a removal of conviction, or motion for new trial.

Prior Criminal History Can Lead to a More Serious Sentence

best criminal defense attorney Ann Arbor

Prior felony convictions can lengthen your sentence in two ways:

  1. Prior record scoring – Your prior records can greatly extend a new sentence, depending on the number and types of offenses.
  2. Habitual sentencing enhancement – Prosecutors may use your prior records to apply habitual offender enhancements, extending sentences already lengthened by prior variable scoring by another 100%.
